Terms and Conditions

Pilgrim’s Rock, LLC provides Services (defined below) to you. If you choose to access, browse, or use these Services, you are subject to the following Terms and Conditions (“TCS”) and by utilizing, accessing, or browsing any Services we offer, you agree and accept without limitation or qualification these TCS. If you do not agree with or wish to be bound to the TCS, do not access or use the Services provided by Pilgrim’s Rock, LLC. Any updates to the TCS will be posted on the Pilgrim’s Rock website www.pilgrimsrock.com.

Pilgrim’s Rock, LLC provides Services to you in a variety of ways including but not limited to utilization of hosted online Moodle software to provide online courses. Other types of Services may include use of software to provide live video instruction, chat sessions, and other types of interaction for students. Most of the online courses are for-fee; some may be provided free of charge. All Services are provided “AS IS” and Pilgrim’s Rock, LLC assumes no responsibility for the timeliness, availability, deletion, mis-delivery, or failure to store any user communications, content, or personalization.

You also understand and agree that the Services may include communications, service announcements, administrative messages, product updates, and other forms of communications which you will not be able to opt out of. To use the Services, you are responsible for obtaining access to the World Wide Web through any means or device of your choice through any paid or unpaid services for access you provide. You must also provide all equipment or technology necessary to use or connect to any Services.

You must pay all fees and charges associated with your use of the Services. All fees and other charges are subject to change at the discretion of Pilgrim’s Rock, LLC.

When using Services, you agree to provide and maintain true, accurate, current, and complete information about yourself upon Services registration or payment. If you provide information or Pilgrim’s Rock, LLC has reasonable grounds to suspect information you provide is untrue, inaccurate, not current, or incomplete, Pilgrim’s Rock, LLC has the right to suspend or terminate your account or refuse any and all current and future use of Services.

Use of Services may require registration and creation of a user name and password. You are solely responsible to maintain these login credentials and other information needed to use the Services. You are fully responsible for all activities that occur under your user identification and password. You agree to notify Pilgrim’s Rock, LLC of any unauthorized use of your user identification and password or other breach of security. You agree to end each online course session in the Moodle software by using the logout link. You may not transfer or share your account with any other person unless it is your parent or legal guardian when you are a minor under the age of 18. The parent or legal guardian assumes full responsibility for the creation and use of Services by their minor child or person under their legal guardianship. Pilgrim’s Rock, LLC cannot and will not be responsible or held liable for any loss or damage arising from your failure to comply with this section.

In using the Services, you may upload, submit, or otherwise make available content which remains your sole responsibility and your property. Pilgrim’s Rock, LLC is not responsible for any content uploaded or make available while using the Services by any user. By uploading or otherwise making available any user content, you automatically grant and/or warrant that you, the owner, have granted permission to Pilgrim’s Rock, LLC, the perpetual royalty-free, non-exclusive right and license to use, reproduce, modify, publish, distribute, perform, display, and transmit the user content through the Services to provide the Services and/or to enable support representatives or administrative staff to assist users when an issue arises. We encourage you to backup and maintain a copy of all user content you upload or otherwise make available to Services. Pilgrim’s Rock, LLC assumes no responsibility for the deletion of any user content. Pilgrim’s Rock, LLC reserves the right to review and remove any objectionable user content for any reason.

If you are under the age of 18, a parent or legal guardian must give written consent for you as a minor to use the Services. Both the TCS, Privacy Policy, and the COPPA Parental Consent must be read and agreed to before you may begin using the Services. This will be verified before you are granted access to any online course (other than any free sample courses accessible to the general public). Your parent or legal guardian will be responsible for all content posted by you in utilizing the Services. Your parent or legal guardian may be granted access to your account upon their request.

Your conduct in using Services will abide by all laws, regulations, and rules pertaining to Services. Any objectionable user content can and will be removed at the sole discretion of Pilgrim’s Rock, LLC. Any conduct that violates laws, regulations, rules or standards set forth by Pilgrim’s Rock, LLC may result in suspension of a user account or access to any and all Services. If any criminal conduct or user content that violates laws, regulations or rules pertaining to the Services or any federal, state, local or other laws is discovered, you agree and acknowledge that Pilgrim’s Rock, LLC may preserve user content or disclose user content or other facts and information pertaining to the user if required to do so by law or in the good faith belief that any such preservation or disclosure is reasonably necessary to comply with legal process or to respond to claims that user content or user conduct has violated laws, regulations, the rights of third parties, rights of Pilgrim’s Rock, LLC, its users or the public. If Pilgrim’s Rock, LLC is required by applicable laws, legal process, or government action to produce information, files, documents or provide personnel as witnesses with respect to these TCS, the Privacy Policy, or the COPPA Parental Consent or any Services, you shall reimburse Pilgrim’s Rock, LLC for any professional time and expenses and reasonable external or internal legal costs included in complying with and responding to requests incurred connected with any user breach of laws, regulations or rules as stated in these TCS, unless Pilgrim’s Rock, LLC is a party to the proceeding or subject to investigation. No refund for Services will be granted to any user if account termination occurs as a result of criminal or illegal user content or use of Services.
